Regulation respecting the standards for diploma = equivalence=20 or training equivalence for the issue of a permit by the Ordre des=20 orthophonistes et audiologistes du = Qu=C3=A9bec

Professional Code

DIVISION I
GENERAL

1. This=20 Regulation applies to every person who does not hold a diploma giving = access to=20 the permit of the Ordre des orthophonistes et audiologistes du = Qu=C3=A9bec and who=20 applies for the recognition of a diploma issued by an educational = institution=20 situated outside Qu=C3=A9bec as equivalent for the purpose of obtaining = a=20 permit.

It also applies to every = person who=20 neither holds a diploma giving access to the Order's permit nor a = diploma issued=20 by an educational institution situated outside Qu=C3=A9bec that may be = recognized as=20 equivalent under this Regulation and who applies for the recognition of = training=20 received in Qu=C3=A9bec or elsewhere as equivalent to the diploma giving = access to=20 the permit, for the purpose of obtaining that permit.

2. In this=20 Regulation,

=E2=80=9Cdiploma giving = access to the permit=E2=80=9D=20 means a diploma recognized by regulation of the Government as giving = access to=20 the permit of the Order, made under the first paragraph of section 184 = of the=20 Professional Code (R.S.Q., c. C-26);

=E2=80=9Cdiploma = equivalence=E2=80=9D means the=20 recognition by the Order, pursuant to subparagraph g of the = first=20 paragraph of section 86 of the Professional Code, that a diploma issued = by an=20 educational institution situated outside Qu=C3=A9bec certifies that a = candidate's=20 level of knowledge and skills is equivalent to the level that may be = attained by=20 the holder of a diploma giving access to the permit;

=E2=80=9Ctraining = equivalence=E2=80=9D means the=20 recognition by the Order, pursuant to subparagraph g of the = first=20 paragraph of section 86 of the Professional Code, that a candidate's = training=20 has enabled him to attain a level of knowledge and skills equivalent to = the=20 level that may be attained by the holder of a diploma giving access to = the=20 permit.

3. The=20 secretary of the Order shall forward a copy of this Regulation to a = person=20 applying for a diploma or training equivalence for the purposes of = obtaining a=20 permit from the Order.

DIVISION II
STANDARDS FOR EQUIVALENCE OF=20 DIPLOMAS

4. A person=20 holding a master's degree in speech therapy or audiology issued by a = Canadian=20 university situated outside Qu=C3=A9bec shall be granted a diploma=20 equivalence.

5. Except=20 in the case provided for in section 4, a person holding a diploma in = speech=20 therapy or audiology issued by an educational institution situated = outside=20 Qu=C3=A9bec shall be granted a diploma equivalence if that diploma was = issued upon=20 completion of master's-level studies comprising a minimum of 60 credits = for=20 courses and practical work and a minimum of 350 hours of clinical = practicum and=20 internship.

Each credit corresponds to = 15 hours of=20 formal courses, 30 hours of attendance at laboratory exercises or 45 = hours of=20 supervised clinical practicum. The hours of clinical practicum and = internship=20 shall involve direct contact with clients. The credits and hours of = clinical=20 practicum and internship shall be distributed as described in Schedule=20 I.

DIVISION III
STANDARDS OF EQUIVALENCE OF=20 TRAINING

6. A person=20 shall be granted a training equivalence if he acquired, upon completion = of at=20 least 5 years of relevant work experience, knowledge and skills = equivalent to=20 those acquired by a holder of a diploma recognized as giving access to = the=20 permit.

7. In=20 appraising the training presented in support of an application for = training=20 equivalence, the Order shall take the following factors into account, in = particular:

(1) type = and years=20 of experience;

(2) type = of courses=20 taken and course content;

(3) clinical=20 practicum served;

(4) total years of=20 education; and

(5) the = fact that=20 the candidate holds one or more diplomas issued in Qu=C3=A9bec or=20 elsewhere.

DIVISION IV
PROCEDURE FOR RECOGNITION OF=20 EQUIVALENCE

8. A person=20 who, for the purpose of obtaining a permit of the Order, must be granted = a=20 diploma or training equivalence shall provide the secretary of the Order = with=20 the following documents and information:

(1) an = application=20 in writing to that effect, along with the filing of study fees = prescribed=20 pursuant to paragraph 8 of section 86.0.1 of the Professional Code = (R.S.Q.,=20 c. C-26);

(2) his = academic=20 record, with a description of the courses taken, the number of course = hours=20 completed or credits obtained, and an official transcript of the marks=20 obtained;

(3) a = true copy of=20 the diplomas he holds;

(4) a = document=20 issued by the educational institution or competent authority, attesting = to the=20 candidate's participation in and successful completion of any practicum, = internship or practical work;

(5) a = document=20 attesting to his relevant work experience in the field of speech therapy = or=20 audiology, with a description thereof;

(6) where=20 applicable, an official document attesting to any additional training = received=20 during the last 5 years; and

(7) where=20 applicable, any information related to the factors that may take into = account=20 pursuant to section 7.

Where documents submitted = in support of=20 an application for recognition of an equivalence are written in a = language other=20 than French or English, they shall be accompanied by a translation in = French,=20 certified in a sworn statement by the person who did the=20 translation.

9. The=20 secretary of the Order shall forward the documents and information = prescribed in=20 section 8 to a committee formed by the Bureau of the Order, in = accordance with=20 paragraph 2 of section 86.0.1 of the Professional Code, to study = equivalence=20 applications and make an appropriate recommendation to the Bureau of the = Order.

In order to make an = appropriate=20 recommendation, the committee may require the applicant to pass an = examination=20 or to complete a clinical practicum or both.

10. At the=20 first meeting of the Bureau of the Order following receipt of the = committee's=20 recommendation, the Bureau shall decide

(1) to = grant a=20 diploma or training equivalence; or

(2) to = deny a=20 diploma or training equivalence.

The Bureau of the Order = shall send a=20 written notice of its decision to the person in question by registered = mail,=20 within 15 days of the date on which the decision was = made.

Where the Bureau decides not = to grant a=20 diploma or training equivalence, it shall, on the same occasion, inform = the=20 candidate in writing of the programs of study leading to a diploma = giving access=20 to the permit or of additional training that should be successfully = completed=20 within the time period indicated by the Bureau, taking into account the=20 candidate's level of knowledge and skills at the time of his = application, for=20 the equivalence to be granted.

11. A=20 candidate who is informed of the board of directors's decision not to = recognize=20 the diploma or training equivalence applied for may apply for review, = provided=20 that the candidate applies to the secretary in writing within 30 days of = the=20 mailing of the board of directors's decision.

The decision must be = reviewed within 60=20 days of receipt of the application by a committee formed by the board of = directors made up of persons other than members of the board of = directors or the=20 committee referred to in section 9, but with no less than a member = holding a=20 permit of each of the 2 categories established within the Order. Before=20 disposing of the review application, the committee must allow the = candidate to=20 make submissions.

For this purpose, the = secretary of the=20 Order must inform the candidate of the date, time and place of the = meeting where=20 the application will be examined, by means of a written notice sent by=20 registered mail at least 15 days before the date of the=20 hearing.

A candidate who wishes to = make=20 submissions in person at the meeting must notify the secretary at least = 5 days=20 before the date scheduled for the meeting. The candidate may, however, = send=20 written submissions to the secretary at any time before the date = scheduled for=20 the meeting.

The decision of the = committee is final=20 and must be sent to the candidate in writing by registered mail within = 30 days=20 following the date it is made.

12. This=20 Regulation replaces the Regulation respecting the standards for = equivalence of=20 diplomas issued by educational establishments outside Qu=C3=A9bec, for = the issue of a=20 permit by the Ordre professionnel des orthophonistes et audiologistes du = Qu=C3=A9bec,=20 made by Order in Council 282-93 dated 3 March 1993.

However, an application for = a diploma=20 equivalence shall be decided on the basis of the replaced Regulation = where the=20 committee referred to in section 6 of that Regulation has sent a = recommendation=20 to the Bureau of the Order in respect of that application before 2 = October=20 1998.
